కాంట్రాక్టు, పర్మినెంటు తేడా లేదు.. ఒకే పనికి ఒకే వేతనం

ఇది ఉద్యోగుల హక్కు.. కాంట్రాక్టు పేరిట తక్కువ జీతం తప్పుశ్రమ దోపిడీకి కృత్రిమ ప్రాతిపదికలు చెల్లవు.. సుప్రీం సంచలన తీర్పు

'కాంట్రాక్టు ఉద్యోగులకూ శాశ్వత ఉద్యోగులతో సమానంగా వేతనాలు చెల్లించాల్సిందే' అని సుప్రీంకోర్టు స్పష్టం చేసింది. ప్రభుత్వ, ప్రభుత్వరంగ సంస్థల్లో కాంట్రాక్టు పద్ధతిలో పని చేస్తున్న లక్షలాది మంది ఉద్యోగులు, కార్మికులకు ఊరటనిచ్చేలా ఆదేశాలు జారీ చేసింది. 'ఒకే పనికి... ఒకే రకమైన వేతనం' అన్న విధానాన్ని అనుసరించాల్సిందే అని స్పష్టం చేసింది. జస్టిస్‌ జేఎస్‌ ఖేహర్‌, జస్టిస్‌ ఎస్‌ఏ బాబ్డేలతో కూడిన ధర్మాసనం బుధవారం ఈ ఆదేశాలు జారీచేసింది.

పంజాబ్‌ రాష్ట్రానికి చెందిన ఒక కాంట్రాక్టు ఉద్యోగి దాఖలు చేసిన కేసులో సుప్రీంకోర్టు ఈ తీర్పు చెప్పింది. రెగ్యులర్‌ ఉద్యోగులతో సమానంగా తనకు వేతనం చెల్లించాలని ఆయన కోరారు. అయితే... కాంట్రాక్టు ఉద్యోగులకు పర్మినెంట్‌ ఉద్యోగుల్లా వేతనాలు వర్తించవని పంజాబ్‌, హరియాణా ఉమ్మడి హైకోర్టు తీర్పు చెప్పింది.
ఈ తీర్పును సుప్రీంకోర్టు ఇప్పుడు పక్కన పెట్టింది. ''ఒక రకమైన పని చేస్తున్న వారందరికీ ఒకే విధమైన వేతనం అందాలి. కార్మికులకు వారి ప్రయోజనాలు అందకుండా చేసేందుకు కృత్రిమ ప్రాతిపదికలు సృష్టించడం తప్పు. ఒకవిధమైన బాధ్యతలు నిర్వర్తిస్తూ, ఒకే రకమైన పని చేస్తున్న వ్యక్తికి (కాంట్రాక్టు పేరిట)...
మరొకరికంటే (పర్మినెంట్‌) తక్కువ జీతం ఇవ్వడం కుదరదు. మరీ ముఖ్యంగా సంక్షేమ రాజ్యంలో అస్సలు కుదరదు'' అని ధర్మాసనం పేర్కొంది. ''ఎవ్వరూ తమ ఇష్టం ప్రకారం తక్కువ వేతనం తీసుకుని పని చేయడు. తమ కుటుంబాన్ని పోషించుకునేందుకు...
తప్పని సరి పరిస్థితుల్లో తన ఆత్మగౌరవాన్ని, హుందాను, స్వీయ విలువను తగ్గించుకుని మరీ తక్కువ జీతానికి పని చేస్తారు. అలా చేయకపోతే తమపై ఆధారపడిన వారికి ఇబ్బందులు తలెత్తుతాయని తెలుసు'' అని తీర్పు రాసిన జస్టిస్‌ ఖేహర్‌ పేర్కొన్నారు. ''ఒకే రకమైన పరిస్థితుల్లో, ఒకేరకమైన పని చేసే వారి మధ్య వేతనాల్లో తేడా ఉండటమంటే... శ్రమను దోచుకోవడమే.
ఇది కచ్చితంగా అణచివేత చర్యే'' అని స్పష్టం చేశారు. 'అంతర్జాతీయ ఆర్థిక, సామాజిక, సాంస్కృతిక హక్కుల ఒప్పందంపై భారత 1979 ఏప్రిల్‌ 10వ తేదీన సంతకం చేసింది. దీని ప్రకారం సమాన పనికి సమాన వేతనం పొందే హక్కు లభించింది. దీనిని నుంచి ప్రభుత్వం తప్పించుకోజాలదు.
అంతేఆదు... భారత రాజ్యాంగంలోని ఆర్టికల్‌ 141 ప్రకారం సుప్రీంకోర్టు చెప్పిన తీర్పు ప్రకారం కూడా సమాన పనికి సమాన వేతనం పొందడమనేది తిరుగులేని హక్కు. ఉద్యోగి పర్మినెంటా, కాంట్రాక్టా అనే అంశంతో నిమిత్తం లేదు'' అని ధర్మాసనం తేల్చి చెప్పింది.


LANDMARK JUDGMENT BY SUPREME COURT FOR PAYMENT OF “EQUAL PAY FOR EQUAL WORK” TO THE DAILY WAGE EMPLOYEES, ADHOC APPOINTEES, EMPLOYEES APPOINTED ON CASUAL BASIS, CONTRACTUAL EMPLOYEES AND THE LIKE.

The Hon’ble Supreme Court in its Historical 102 pages Judgment in Civil Appeal No. 2013 of 2013 dated 26.10.2016 has directed that Temporary Employees, Adhoc Appointees, employees appointed on Casual basis, contractual employees and the like, if the concerned employees are rendering similar duties and responsibilities as were being discharged by regular employees holding the same/corresponding posts are entitled “for equal pay for equal work” such employees are entitled for draw wages at the minimum of the payscale extended to regular employees holding the same posts. We will be representing to the Govt. To implement this Judgment and issue a common order in this regard. Full judgement is reproduced below:

DA 2% ANNOUNCED TO C.G.EMP.WEF 01-07-2016

Cabinet approves release of an instalment of Dearness Allowance to Central Government employees and Dearness Relief to Pensioners due from 01.07.2016

The Union Cabinet under the Chairmanship of Prime Minister Shri Narendra Modi has given its approval to release an instalment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to Pensioners w.e.f. 01.07.2016 representing an increase of 2% of the revised Basic Pay/Pension, to compensate for price rise. The increase is in accordance with the accepted formula, which is based on the recommendations of the 7th Central Pay Commission.
The combined impact on the exchequer on account of both Dearness Allowance and Dearness Relief would be Rs. 5622.10 crore per annum and in the Financial Year 2016-17 for the period of 8 months (i.e. from July 2016 to February 2017), it would be Rs.3748.06 crore. About 50.68 lakh Government employees and 54.24 lakh pensioners will be benefitted.

Dear Comrades,

As you are aware, the National Secretariat of the Confederation has decided to organize three-phase agitational programmes protesting against the totally negative attitude of the Government against the Central Government employees and pensioners and also demanding immediate settlement of their legitimate demands, including increase in minimum pay and fitment formula as assured by three Cabinet Ministers including Home Minster, Finance Minister and Railway Minister.
1st Phase – 20.10.2016    –   Protest demonstration and gate meetings. Adopting and sending resolution to Government.
2nd Phase – 07.11.2016   –   Mass Dharna
3rd Phase – 15.12.2016   –   Massive Parliament March

It is also decided that the agitational programmes shall culminate in strike, jointly with all like minded organisations.
SERIOUS PREPERATIONS FOR PARLIAMENT MARCH SHOULD BEGIN NOW ITSELF
The National Secretariat has decided to ensure participation of not less than 20000 central Govt. Employees in the Parliament March on 15.12.2016. The following quota has been fixed to each affiliated organization and C-O-Cs. Only two months are left now. It is needless to say that the participation of 20000 employees can be ensured only if each affiliated organization and COC make sincere and conscious effort to ensure the participation of maximum employees from their organization/C-O-C as per quota fixed. Employees are ready, only thing is that leaders should take the initiative to mobilise them.
Each affiliated organisation should fix quota to their state/District/Divisional units. Similarly each C-O-C should fix quota to each affiliated organization at state/District level. This work should be done in a serious and systematic manner on top priority basis. Continuous follow up action on day-to day basis is also required.Travel tickets, special vehicles etc. should be booked well in advance. Waiting upto the last minute and then stating non-availability of tickets as reason for non-participation or less participation should be avoided. Maximum flags and banners are also to be brought by each unit of organization/COCs.
All affiliated organisations and C-O-Cs are requested to give wide publicity to the Parliament March through all means of Communications including print and electronic media, websites and social media. Let us all join together to make the Parliament March a historic event and grand success.
Copy of the circulars fixing quota to each Unit/organization issued by all Affiliated of Confederation and C-O-Cs may be emailed to Confederation CHQ for publishing in the website.

CHARTER OF DEMANDS
1.      Settle the demands raised by NJCA regarding modifications of 7th CPC recommendations as submitted in the memorandum to Cabinet Secretary on 10th December 2015. (See Annexure-I). Honour the assurance given by the Group of Ministers to NJCA on 30th June 2016 and 6thJuly 2016, especially increase in minimum wage and fitment factor. Grant revised HRA at the existing percentage itself i.e. 30%, 20% and 10%. Accept the proposal of the staff side regarding Transport Allowance. Settle all anomalies arising out of implementation of 7th CPC recommendations, in a time bound manner.
2.      Implement option-I recommended by 7th CPC and accepted by the Government regarding parity in pension of pre-2016 pensioners, without any further delay. Settle the pension related issues raised by NJCA against item 13 of its memorandum submitted to Cabinet Secretary on 10th December 2015. (See Annexure-I).
3.      Scrap PFRDA Act and New Pension System (NPS) and grant pension and Family Pension to all Central Government employees recruited after 01.01.2004, under CCS (Pension) Rules 1972.
4.      Treat Gramin Dak Sewaks of Postal department as Civil Servants, and extend all benefits like pay, pension, allowances etc. of departmental employees to GDS. Enhance bonus calculation ceiling of GDS also to 7000 from 01.04.2014.
5.      Regularise all casual, contract, part-time, contingent and Daily rated mazdoors and grant equal pay and other benefits. Revise the wages as per 7th CPC minimum pay.
6.      No Downsizing, Privatisation, outsourcing and contractorisation of Government functions.
7.      Withdraw the arbitrary decision of the Government to enhance the bench mark for performance appraisal for promotion and financial upgradations under MACP from “GOOD” to VERY GOOD” and also decision to withhold annual increments in the case of those employees who are not able to meet the bench march either for MACP or for regular promotion within the first 20 years of service. Grant MACP pay fixation benefits on promotional hierarchy and not on pay-matrix hierarchy. Personnel promoted on the basis of examination should be treated as fresh entrants to the cadre for grant of MACP.
8.      Withdraw the draconian FR 56 (J) and Rule 48 of CCs (Pension) Rules 1972 which is being misused as a short cut as purity measure to punish and victimize the employees.
9.      Fill up all vacant posts including promotional posts in a time bound manner. Lift ban on creation of posts. Undertake cadre Review to access the requirement of employees and their cadre prospects. Modify recruitment rules of Group-‘C’ cadre and make recruitment on Reginal basis.
10.  Remove 5% ceiling on compassionate appointments and grant appointment in all deserving cases.
11.  Grant five promotions in the service carreer to all Central Govt. employees.
12.  Abolish and upgrade all Lower Division Clerks to Upper Division Clerks.
13.  Ensure parity in pay for all stenographers, Assistants, Ministerial Staff in subordinate offices and in all organized Accounts cadres with Central Secretariat staff by upgrading their pay scales. Grant pay scale of Drivers in Loksabha Secretariat to Drivers working in all other Central Government Departments.
14.  Reject the stipulation of 7th CPC to reduce the salary to 80% for the second year of Child Care leave and retain the existing provision.
15.  Introduce Productivity Linked bonus in all department and continue the existing bi-lateral agreement on PLB wherever it exists.
16.  Ensure cashless medical treatment to all Central Government employees & Pensioners in all recognized Government and Private hospitals.
17.  Revision of Overtime Allowance (OTA) and Night Duty Allowance (NDA) w.e.f 01.01.2016 based on 7th CPC pay scale.
18.  Revision of wages of Central Government employees in every five years.
19.  Revive JCM functioning at all levels. Grant recognition to the unions/Associations under CCS (RSA) Rules 1993 within a time frame to facilitate effective JCM functioning.
