DRAFT TERMS OF REFERENCE 7th CPC:

Finalized by the Staff Side at the meeting of 25.10.2013.

A.     To examine the existing structure of pay, allowances and other benefits/facilities, retirement benefits like Pension, Gratuity, other terminal benefits etc. to the following categories of employees.

1       Central Government employees – industrial and non industrial;
2       Personnel belonging  to  All India services;
3       Personnel belonging to the Defence Forces;
4       Personnel called as Grameen Dak Sewaks belonging to the Postal   Department;
5        Personnel  of Union Territories;
6      Officers and employees of the Indian Audit and Accounts                     Department;
7       Officers and employees of the Supreme Court;
8       Members of Regulatory bodies (excluding RBI) set up under Act of      Parliament.

B.     To work out the comprehensive revised pay packet for the categories of Central Government employees mentioned in (A) above as on 1.1.2014.

C.     The Commission will determine the pay structure, benefits facilities, retirement benefits etc. taking into account the need to provide minimum wage with reference to the recommendation of the 15th Indian Labour Conference (1957) and the subsequent judicial pronouncement of the honorable Supreme Court there-on, as on 1.1.2014.

D.     To determine the Interim Relief needed to be sanctioned immediately to the Central Government employees  and  Pensioners mentioned in (A) above;

E.     To determine the percentage of Dearness allowance/Dearness Relief immediately to be merged with Pay and pension 

F.      To settle the anomalies raised in various fora of JCM.                                                     

G.    To work out the improvements needed to the existing  retirement benefits, like pension, death cum retirement gratuity, family  pension and other terminal or recurring  benefits maintaining parity amongst past, present and future pensioners and family pensioners including those who entered service on or after 1.1.2004.

H.    To recommend methods for providing cashless/hassle-free Medicare facilities to the employees and Pensioners including Postal pensioners.

COMING, PRIVATISATION OF RAILWAY PASSENGER SEGMENT

          The Railways on Tuesday set the ball rolling for privatising its passenger segment on its existing infrastructure with the launch of theHigh Speed Rail Corporation (HSRC).
Railway Minister Mallikarjun Kharge launched the HSRC as a fully-owned subsidiary of Rail Vikas Nigam Limited, which his predecessor Nitish Kumar had set up with the objective of raising extra budgetary resources — from the market and private investors.Mr. Kharge, however, issued a word of caution against adopting new technology.

NO TECHNOLOGY FOR GRATIS

“You should not buy horses merely because horse shoes are freely available,” was Mr. Kharge’s caution. He stressed how technology could be made available for even free. “At times they tell us how cheap it is. The question is whether it suits us or not, not whether it is cheap or free.” He launched the corporation at an “International Conference on HighSpeed Rail Travel — Low Cost Solutions.”
Mr. Kharge, however, underlined the need for high speed rail while focusing on providing a mass mode of safe, reliable and affordable transport. Railway Board Chairman Arunendra Kumar said the Corporation, as the implementing agency, would contribute in the joint venture to be formed under the Public Private Partnership mode. The other stakeholders could be the State governments and private investors, explained corporation chairman Satish Agnihotri.
SEVEN ROUTES

The Railways have identified seven routes — all commercially viable — on which the mini high speed trains with a speed of 160 km per hour to 200km per hour would be operated under the PPP mode. Officials maintained a stoic silence when asked if the railways were giving away the most viable routes to the private sector.Some of the routes identified are Ahmedabad-Mumbai, Amritsar-Ludhiana-Chandigarh-Delhi, Agra-Lucknow-Varanasi-Patna, Chennai-Thiruvananthapuram and Bangalore-Chennai. The first project to be implemented under the scheme will be the Mumbai-Ahmedabad route.

VII CPC - TERMS OF REFERENCE - LATEST POSITION

Dear Comrades,
VII-CPC – Terms of reference-
            The members of the National Secretariat of the Confederation available at New Delhi met on 23rd Oct. 2013 and again on 24th October, 2013 to discuss and formulate our views on the 7th CPC terms of Reference.  On the basis of the discussions, we prepared a draft terms of reference and submitted it for consideration of the Staff Side.  The important points we placed in our draft for the consideration of the staff side were:-
(a)   The Commission to examine the present structure of pay and allowances and suggest changes.
(b)   To give effect to its recommendations from 1.1.2011 i.e. wage revision must be after       every five years.
(c)   D.A (50%) to be merged with pay with effect from 1.1.2011.
(d)   To determine Interim relief taking into account the erosion in the value of wages over the years,
(e)   To include GDS within the ambit of the 7th Central Pay Commission.
(f)     To revise the retirement benefits and accord pension maintaining parity in quantum in respect of past, present and future pensioners.
(g)   To extend the statutory defined benefit pension to those who have entered service after 1.1.2004.
(h)   To settle the anomalies raised in various fora of JCM on a priority basis and within a specified time frame.
(i)     To provide cashless/hazzle free Medicare to employees and pensioners.
The Government of India had convened a meeting of the Staff side representatives on 24.10.2013 to discuss the terms of reference.  The meeting took place at 3.00PM on 24th under the Chairmanship of Secretary, Personnel.  Besides the points mentioned above, the staff raised many other matters connected with the setting up of the CPC. viz. the inclusion of labour Representative as a Member of the Commission; the anomalous  situation brought about by the Grade pay based MACP Scheme; the requirement of a mechanism to settle the 6th CPC related anomalies;  the need to allow the proposals of Cadre Review to be examined by the Government independently without referring it to CPC;  to have members in the Commission who have gained  expertise to impart to the Commission the nuances and functional requirements of various Departments;  to relook at the new Pay Structure brought in by the 6th CPC in the light of the experience between 2008 to 2013 etc.  In conclusion the staff side requested the Government to provide it with a draft terms of reference taking into account the views placed by them.  It was also proposed by the Staff Side that on exchange of the draft terms of reference prepared by the Staff Side and the  Official Side, a meeting with the Secretary, Personnel and Secretary, Expenditure could be arranged to iron out the differences, if any.
The Staff Side met again on 25th at its office and deliberated upon various views presented by different organisations and finalised the draft terms of reference. We shall publish the said draft terms of reference as and when the same is submitted to the Government.
It is obvious that despite the unanimous position taken by all the organisations, the Government may not necessarily agree with many of the basic issues, viz. Date of effect, merger of  DA, Interim Relief, Coverage of GDS etc.  We appeal to our affiliates/ State COCs to continue the campaign amongst the employees to generate necessary sanctions.

             Orders reinstating into service  Com. S.C.Jain  Ex-Circle Secretary P3 NFPE Madhya Pradesh Circle  who was compulsorily retired from service for trade union activities, issued today as per the direction given by Directorate to the CPMG.
           NFPE and P3 CHQ has taken up the case with Secretary, Department of Posts. This is the great victory of NFPE in the fight against trade union victimization.

FINALISATION OF TERMS OF REFERENCE
GOVERNMENT INVITED JCM STAFF SIDE FOR DISCUSSION ON 24.10.2013

Secretary, Department of Personnel & Training will hold discussion with JCM National Council, Staff Side today (24.10.2013) at 3 PM. Meeting of the Staff side will be held at 11 AM to formulate the staff side approach. Confederation available National Secretariat members met on 23.10.2013 in the presence of Com. S. K. Vyas and finalized the draft terms of reference of Confederation. Details will be published after the meeting with Secretary, DOP&T.=posted by CHQ

FLASH NEWS

NFPE & FNPO DECIDED TO GO ON NATIONWIDE INDEFINITE STRIKE IF THE DEMAND FOR INCLUSION OF GRAMIN DAK SEVAKS UNDER THE PURVIEW OF 7TH CENTRAL PAY COMMISSION IS NOT ACCEPTED BY THE GOVERNMENT. THE MAIN DEMANDS OF THE STRIKE WILL BE
(1) Inclusion of Gramin Dak Sevaks under the purview of 7th CPC
(2) Regularisation of Casual, Part-time, Contingent Employees and Revision of their wages with effect from 01.01.2006 (as per 6th CPC wage revision) & Grant of DA
(3) Merger of 50% DA with pay for all employees including GDS

SALIENT FUATURES OF PFRDA BILL

  1. The Pension Fund Regulatory and Development Authority (PFRDA) Bill 2011 will give statutory powers to the PFRDA, which was established in August 2003 as a regulator for the pension sector which followed private players entering.

  2. The passage of the bill could see pure pension products coming into the market. Currently pension products available in the market are a part of insurance packages.

  3. The Pension Fund Regulatory and Development Authority Bill 2011 seeks to promote the pension sector by establishing a regulator as India does not have a universal social security system.

  4. The Bill allows 26 per cent foreign direct investment (FDI) in pension funds

  5. In 2005, the UPA I government had earlier introduced a pension bill but it lapsed as the Lok Sabha's term got over before the legislation could be passed.

  6. The Pension Fund Regulatory and Development Authority Bill 2011 was reintroduced in the Lok Sabha in 2011 by the then finance minister Pranab Mukherjee and it was subsequently referred to a standing committee.

  7. PFRDA's National Pension System (NPS) was made mandatory for all new government recruits, except armed forces, joinig after January 1, 2004.

  8. The NPS was later opened up to all Indian citizens from 2009 on a voluntary basis.

  9. The NPS allows its subscribers to invest in stock markets but there is a cap on equity investment. The NPS also offers subscribers the option of selecting the fund managers of their choice.

  10. The pension bill could help channelize funds into building long-term assets for the country, including the infrastructure sector. The government wants to ease rules for insurance and pension sectors to allow them to invest in infrastructure, where it is seeking $1 trillion investment till 2017.

The Postmaster General, Hyderabad / Kurnool / Vijayawada / Visakhapatnam Regions are requested to issue necessary orders to the officials concerned immediately against the identified norm based posts in Divisions in which they are working at present to the extent possible or in the neighboring Division of their respective Regions, where the vacancies in the cadre are available.

On receipt of the posting orders, the official may please be relieved immediately to join in his promotional post in case there are no Vigilance / Disciplinary case pending against him.

                   If the official is  drawing the pay scale of Rs. 5200 – 20200 with grade pay of Rs. 2800/- and Rs. 9300 – 34800 with grade pay of Rs. 4200/-  is not eligible for any pay fixation under the provisions of FR 22(I) (a) (1).  If the official is not drawing the pay in the pay scales referred to above may exercise their option for pay fixation under the provisions of FR 22(I) (A) (1) within one month from the date of assuming the charge in the new post.

The official should accept / decline the promotion unconditionally in writing within one month from the date of issuance of this order.  

In case the official declines promotion, an unconditional declination letter may please be obtained immediately and to be forwarded to this office for its acceptance.  If any official declines promotion, he / she should note that he / she is not eligible for promotion to the cadre of Norm based LSG (Postal) for a period of 1 (one) year either on regular or adhoc basis from the date of declination.  Further, the official who declines promotion will not be considered for financial upgradation under MACP Scheme, if any due, as per the existing rules / instructions till they accept promotion.

The Postmasters General are requested to instruct the Divisional Superintendents concerned to relieve the officials forthwith with a direction to them to join in the promotional post of LSG cadre on or before 10.11.2013.  The date of joining of officials in the LSG cadre may please be intimated in due course.

No representation for reallotments will be entertained before joining in the new post in LSG cadre in the Region allotted.   Hence, representations received from the officials for reallotment before joining in the promotional post need not be sent to this office.
Charge reports may please be sent to all concerned in due course.
